Right to Object to Processing

You can request to object to the processing of your personal information (including automated decision making), where the processing:

  • Is for the purpose of direct marketing (you can opt out of direct marketing at any time in an EBS network office or by calling 1850 654 321);

  • Is carried out in the legitimate interests of us or third parties. Your right to object to processing based on legitimate interests will only be upheld if we can’t show compelling, legitimate reasons for the processing of your information which takes priority over your rights or we need to process it for establishment, exercise or defence of a legal claim; or

  • Is for scientific or historical research purposes.

You also have the right not to be subject to a decision based solely on automated decision making, where it has a legal effect on you. However, this right does not apply if the automated decision making is necessary for the entering into or performance of a contract between you and us, or if you have explicitly consented to the automated decision making.

If you wish to object to the processing of your personal information based on the above criteria, you should complete a Right to Object Request Form, available to download below. Please complete the form, ensuring all mandatory fields (marked with an asterisk*) are filled, and bring it to any network office with a valid form of ID.

In the event that you are unable to present the form in person, the completed form can be posted to any EBS network office along with a certified copy of photo ID and certified copies of 2 proof of addresses from independent sources. Your photocopies can be certified by a member of An Garda Síochána at your local Garda station, by a solicitor, an accountant, public notary or at your local bank branch.
